1. Scope and Acceptance of the General Terms and Conditions
1.1 These General Terms and Conditions of Sale (hereinafter “GTC”) define the provisions and services between Digistore S.A. and its customers. They apply to any order placed with Digistore S.A., whether in-store or via the online store.
1.2 By placing an order, the customer confirms that they have read the GTC in effect at the time of the order and accept them without reservation. When placing an order online, this acceptance is indicated by checking the box provided for this purpose before confirming the order.
1.3 Digistore S.A. reserves the right to modify these Terms and Conditions at any time. The applicable version is the one in effect on the date of the order.
2. Offer
2.1 Offers made by the Digistore online store at S.A. are non-binding and therefore do not constitute firm offers. The order is finalized upon confirmation via email and delivery of the goods. Offers are subject to the availability of items/products from our suppliers or manufacturers.
2.2 All product information, product photos, technical specifications, links to accessories, etc., are provided without warranty on the Digistore online store website S.A.. The manufacturer’s specifications valid at the time of delivery are binding.
3. Prices
3.1 All prices on Digistore S.A. include value-added tax (VAT) and the advance recycling fee (TAR). Prices are listed net in Swiss francs.
3.2 Additional costs (e.g., shipping, delivery, and installation fees) are listed separately and billed in addition to the purchase price.
3.3 The date of the order is decisive for determining the price. Price changes that occur during the fulfillment of the order will not be taken into account.
3.4 Information is provided subject to technical changes, errors, and typographical errors.
3.5 Digistore S.A. may change its prices at any time without notice; such changes do not affect orders that have already been confirmed, for which the price remains fixed in accordance with Article 3.3.
4. Payment Methods
4.1 Digistore S.A. accepts the following payment methods: prepayment, bank and postal transfers; Visa, Eurocard, and American Express credit cards; and EC Direct and Postcard debit cards.
4.2 The applicable fees are detailed during the payment process.
4.3 In the case of prepayment, the invoice must be paid within 5 days; otherwise, Digistore S.A. may cancel the order.
5. Payment Terms and Retention of Title
5.1 If a customer is late in paying part or all of the amount due for a purchase, Digistore S.A. may suspend remaining deliveries, in whole or in part, without prior notice until the entire amount owed has been paid.
5.2 If a customer fails to settle the outstanding balance after an extension of the payment deadline, Digistore S.A. may demand compensation and proceed in accordance with the provisions of the Swiss Code of Obligations (CO). In particular, Digistore S.A. has the right to delegate debt collection to an external company.
5.3 Digistore S.A. may charge additional fees for certain payment methods and may modify these fees without prior notice.
5.4 Products delivered by Digistore S.A. remain the property of Digistore S.A. until the full purchase amount (including all surcharges) has been paid to Digistore S.A. The customer agrees to take good care of the products as long as they remain the property of Digistore S.A.
6. Deliveries and Partial Deliveries
6.1 The delivery times indicated by Digistore S.A. are provided for informational purposes only. They are not firm dates. If a delivery date cannot be met, the customer may cancel their order after a grace period of at least 30 days, which they must specify to us in writing. Digistore S.A. will then issue a credit note, valid in-store or on the website, equivalent to the amounts already paid. In this case, the customer is not entitled to any additional compensation.
6.2 Digistore S.A. may cancel confirmed orders due to external circumstances beyond its control (force majeure), without any financial consequences.
7. Transportation Risk, Transportation Damage, and Transportation Insurance
7.1 The goods are shipped at the customer’s own risk. However, the goods are covered by limited shipping insurance.
7.2 The customer agrees to immediately verify that the delivered goods are correct, complete, and in good condition. Any damage to the delivered goods must be reported to the shipping company as soon as possible, no later than 3 days after delivery.
7.3 In the event of a claim, all original packaging must be retained until written approval is received from the shipping carrier or Digistore S.A.
8. Right of Return, Return Policy, and Exchange
8.1 Swiss law does not provide for a statutory withdrawal period for online purchases. As a general rule, therefore, goods cannot be returned.
8.2 The return of delivered goods is possible in certain exceptional cases, which always require the written consent of Digistore S.A. In such cases, the customer will receive confirmation and a return number from Digistore S.A..
8.3 Goods must be returned in their original packaging, complete with all accessories and accompanied by the purchase receipt. The return of goods is at the customer’s expense and risk.
8.4 Returns will only be accepted for products that are new, unopened, or unused. In the exceptional case where a product has been opened and/or used and an exception is granted, a discount will be applied, and a refund will be issued only in the form of store credit.
9. Warranty Provisions
9.1 The manufacturer’s warranty provisions (in particular the warranty period) apply to items purchased from Digistore S.A.
9.2 The warranty period for products is 2 years; certain products have warranties of up to 5 years.
9.3 The invoice serves as the warranty certificate and must be kept in a safe place.
9.4 The warranty covers all manufacturing defects (parts and labor); shipping and handling costs are not covered by the warranty.
9.5 An extended warranty is available for certain products.
10. Data Protection
10.1 Digistore S.A. processes its customers’ personal data in accordance with the Federal Data Protection Act (FADP). The data collected is used solely for order processing, billing, delivery, and after-sales service.
10.2 Details regarding the collection, processing, and rights of data subjects are set forth in Digistore’s privacy policy at S.A., which is available on the website.
11. Intellectual Property
11.1 All content on the Digistore website S.A. (text, photographs, logos, trademarks, layouts) is protected by intellectual property rights and remains the property of Digistore S.A. or its partners. Any reproduction or use without written authorization is prohibited.
12. Governing Law and Jurisdiction
12.1 These Terms and Conditions and any dispute arising from an order are governed exclusively by Swiss law.
12.2 In the event of a dispute, the exclusive venue for legal proceedings shall be Geneva, subject to any mandatory venues provided for by law.
